Pre-marital medical examination and the points of agreement and difference between law and Sharia
This research
addresses the topic of medical examination from two main perspectives: Islamic
law and positive law, outlining the frameworks that regulate them and the
related provisions, especially in light of the development of health and legal
systems. The research aims to shed light on an important issue in our practical
lives and the success and positive outcomes achieved by this issue,
highlighting the importance of medical examination for the family and society.
The research relied on a descriptive and comparative approach and reached
several conclusions, the most important of which are: Islamic law supports
premarital medical examinations and encourages them based on its greater
objectives of preserving life and offspring. The coordination between what
Islamic law provides and what positive laws stipulate in this area is a clear
example of the compatibility of religion and reason in order to protect human
beings and build a healthy society based on knowledge, awareness, and
responsibility. Recommendations include: The necessity of developing the laws
regulating it to take into account both Sharia and humanitarian aspects, to
achieve a balance between individual rights and the public interest.
